Complying with Australian law

In response to the newly introduced Anti-Discrimination and Humans Rights Legislation (Respect at Work) Act, Federal Government has changed Australian law to impose a new ‘positive duty’ on all employers. This new legislation requires all employers to take reasonable steps to eliminate sexual harassment and other unlawful behaviour from occurring in the workplace.

Responding to complaints when they arise is no longer enough and active policies must be put in place to eliminate sex-based harassment, no matter the size of the business. As an employer, this means you could be held liable for any complaints made by any member of staff.

Avoiding reputational harm

Failure to comply with the Sex Discrimination Act could not only lead to substantial fines and other detrimental financial penalties, it could also cause severe reputational harm to your business and brand effecting its value, insurance premiums, and a reduced appeal to prospective employees.

We are here to help you conduct a positive duty health check, comply with the seven standard guidelines, and put preventative measures in place to reduce risk.
